AI trade secrets disputes just got sharper for every team that hires across rivals. On October 13, 2026, U.S. District Judge Edward Davila gave Apple expedited access to OpenAI hiring materials in a live trade-secrets case tied to consumer hardware.

That order is not a final verdict. It is a discovery win with teeth. Interview checklists, technical presentations, LINE chats, and forensic device images now sit on a short clock.

I am Nitin from the Debugged Pro team. Below I stick to verified reporting from TechCrunch, Unite.AI, and 9to5Mac, then turn the facts into a hiring and IP plan for agencies in India and the USA.

What the AI Trade Secrets Order Actually Covers

According to TechCrunch coverage by Sarah Perez, Apple will see documents tied to OpenAI interviews of former Apple employees who applied for consumer hardware and robotics roles. That can include checklists, guides, manuals, scripts, and technical presentations that mention Apple technology or parts.

OpenAI has five days to turn over materials it already collected. It has 14 days for other responsive materials. The court also approved early depositions of named former Apple employees now linked to OpenAI hardware work.

Three document buckets the court granted

Forensic images already collected. Devices and images tied to Apple's claims, including materials reviewed by forensic experts in earlier filings.
Interview guidance for Apple candidates. Scripts and deep-dive decks used when OpenAI interviewed Apple talent for hardware or robotics groups, plus records that show Apple tech was discussed.
LINE messages between key people. Conversations between Chang Liu and Yu-Ting ("Alyssa") Peng since January 1, 2026, including chats already cited in declarations.

Unite.AI reporting adds case detail: the matter is Apple Inc. v. Liu in the Northern District of California. Defendants named include Chang Liu, Tang Yew Tan, OpenAI Foundation, OpenAI Group PBC, and io Products LLC.

Why AI Trade Secrets Matter for Software Agencies

Most agencies are not building a consumer AI device. You still hire people who saw another company's unreleased roadmap. You still run technical interviews that dig into past projects. That is exactly where this case bites.

Interview notes become evidence. Courts may ask what your team asked, wrote down, and kept after a competitor hire.
Messaging apps are in scope. Private LINE chats are part of this order. Slack, WhatsApp, and email can face the same risk in other fights.
Device forensics move fast. Judges care when logs and metadata can vanish. Early imaging is no longer rare.
Clients will ask harder questions. Buyers funding AI hardware or agent work want proof you do not import someone else's secrets.

Apple filed in July 2026. It seeks a preliminary injunction and also alleges breaches of Intellectual Property Agreements. Agencies that place talent into AI product teams should assume similar playbooks will spread.

What Apple Alleges, in Plain Words

These points are Apple's claims as summarized in court coverage. They are not proven facts.

Former Apple employees used confidential files about unannounced tech while at OpenAI.
Recruiting interviews became a channel for insider knowledge about Apple parts and designs.
Some coaching allegedly told new hires how to leave Apple with less scrutiny.
Corporate defendants allegedly acted together as OpenAI pushed into consumer hardware.

9to5Mac notes Apple also asked for a preliminary injunction so alleged secrets would not sink deeper into OpenAI hardware work while the case runs. OpenAI opposed expedited discovery as too broad. The judge granted a narrower set instead of a full rummage through research files.

What the Judge Denied or Pushed Later

Balance matters here. Davila did not hand Apple every request on an emergency clock.

Request type	Outcome	Agency takeaway
Interview guides and Apple-candidate deep dives	Granted on expedited timeline	Treat interview scripts as high-risk records
LINE chats between named people	Granted	Personal messaging can still be discoverable
Metal finishes, power, battery R&D docs	Denied for expedited track	Broad competitor R&D fishing is harder early
"Apple Originated Information" requests	Deferred as too vague	Vague IP labels invite pushback; define secrets clearly

Practical read: courts will speed up evidence that can disappear or that sits close to hiring. They will slow requests that look like a general tour of a rival's lab notebooks.

AI Trade Secrets Risks Inside Agency Hiring

If your India or USA delivery team interviews ex-product engineers this month, run this filter before the call.

Do not ask for confidential artifacts. No unreleased specs, internal decks, or customer data from a prior employer.
Separate public skill from private product knowledge. Ask how someone designed a system in general terms. Stop when answers drift into named secret programs.
Ban "bring your old notes" onboarding. New hires should start from clean devices and clean repos you control.
Write interview scripts with counsel. If a dispute ever lands, your script is either a shield or a problem.
Keep a retention rule for interview media. Recordings, scorecards, and shared drives need owners and delete dates.

What AI Trade Secrets Mean for India and USA Agencies

The lawsuit is U.S. federal. Delivery work is local. Brief both markets with the same core hygiene, then tune contract language.

For agencies serving Indian clients

Expect tougher vendor questionnaires on talent sourcing. Banks and product firms will ask how you screen for prior-employer IP.
Use clear IP assignment and confidentiality clauses in contractor and full-time offers, in English plus the language your HR team actually uses day to day.
Split client repos by project. A hire who worked on Client A must not browse Client B by default.
Watch cross-border device policies. Laptops that travel between India and USA offices still hold logs courts care about.

For agencies serving US clients

Name the statute clients already know. Apple's claims include the Defend Trade Secrets Act. Buyers will ask if your process respects that risk.
Map controls to NIST language. US security teams already use the NIST AI Risk Management Framework.
Do not overclaim "clean room" status. Say what is blocked, who reviews interview notes, and how fast you can revoke access.
Keep legal close when messaging apps hold deal talk. This case put LINE chats on the record. Your Slack DMs are not magic.

A Practical AI Trade Secrets Checklist for This Month

Inventory active interviews where candidates left a direct competitor in the last 12 months.
Pull every interview template used for AI, hardware-adjacent, or robotics roles. Remove prompts that seek proprietary details.
Add a spoken disclaimer at the start of technical screens: candidates must not share confidential prior-employer information.
Issue clean hardware on day one. Do not allow personal devices with old employer images into client builds.
Log access to client secrets the same way you log production deploys.
Train managers to stop "just this once" requests for old decks or code.
Brief account leads so client answers stay consistent across India and USA time zones.

If your security program already tracks enterprise tooling spend, pair this checklist with our note on enterprise AI security. Talent risk and tool risk often show up in the same client review.

How to Talk to Clients Without Drama

Clients do not need courtroom theater. They need process.

"We forbid candidates from sharing prior-employer confidential materials."
"Interview scripts are reviewed and retained on a fixed schedule."
"New hires get clean devices and clean repos."
"We can show who accessed which client secrets and when."

When buyers also ask about model evaluation fights, point them to our earlier guide on AI audits and evaluator independence. Keep each topic in its lane: hiring IP here, external eval rights there.

Build Notes for Delivery Leads

Trade-secret hygiene is a delivery feature, not only an HR slide.

1. Put the fence in onboarding, not only in the offer letter

Offer letters get signed and forgotten. Onboarding checklists get used. Add a step that confirms no prior-employer files were copied into work drives.

2. Separate "how you think" interviews from "what you shipped"

Let candidates explain general architecture patterns. Stop when they start naming unreleased SKUs, supplier parts, or internal codenames.

3. Treat interview artifacts like source code

Scorecards, recordings, and shared notes need access control. If a dispute starts, you want a short, clean record, not a sprawling Drive dump.

4. Keep evidence for audits

Store policy versions, training dates, and access logs. When a buyer asks how you follow the NIST AI RMF, you can show Govern and Manage evidence instead of improvising.

Common Gaps We Still See in Agency Projects

Across recent India and USA delivery reviews, the same holes appear. None of them need a frontier lab to create risk.

Interviewers ask for "a sample of your last project." That sample may be someone else's trade secret.
Shared WhatsApp groups hold candidate debriefs. Those chats are easy to forward and hard to delete cleanly.
Contractors reuse personal GitHub gists that still contain prior client snippets.
No owner for interview retention. Files sit forever, then surface in a legal hold with no context.

Fixing these is boring work. It is also the work this order pushes the industry to take seriously. You do not need to wait for a final Apple OpenAI judgment to rewrite a script or rotate a shared folder.

A 30-Day Rollout Plan for Agency Leads

If you manage hiring for AI pilots, use a short calendar.

Week 1: Inventory and classify

List open roles that recruit from competitor product teams. Mark each interview as standard or high IP risk. Share the list with HR and legal.

Week 2: Rewrite the high-risk scripts

Remove prompts that seek proprietary details. Add the spoken disclaimer. Train every interviewer who touches those roles.

Week 3: Prove it with a dry run

Run one mock interview where a candidate tries to overshare. Score whether your interviewer stops them. Fix the miss before the next live screen.

Week 4: Brief and contract

Update proposals and SOWs with IP hygiene language. Tell clients what you block, what you log, and how fast you can revoke access. That conversation builds trust more than a glossy slide.

Keep a single owner for the program. When everyone owns trade-secret hygiene, nobody owns the next miss.
