AI regulation just moved from think tanks and federal panels to a city council chamber. On Monday, October 5, 2026, senior staff from Anthropic, OpenAI, Google and Meta are set to testify under oath before the New York City Council. The topic is simple to state and hard to answer: how dangerous is AI, and what rules should a city put in place?

The hearing starts at 11 a.m. ET, which is 8:30 p.m. in India. As I write this, it has not started yet, so this piece sticks to what is confirmed so far.

Here is what is happening, what the proposed bills say, and what it means for agencies that build or deploy AI.

What Is Happening at the NYC Council AI Hearing

According to CNBC's report on the NYC Council AI hearing, the testimony takes place at a rare "Council Committee of the Whole" session. That means all 51 Council members are expected to attend, not just one committee.

The companies will be asked to explain the threats AI poses and to give input on possible laws. Speaker Julie Menin was direct about why. "Given the high stakes, these firms owe it to the public to come before the Council, answer our questions, and provide input on our proposed legislation under oath," she said.

Who is testifying

Menin's office named the company witnesses on Monday:

Anthropic: Logan Graham, head of its Frontier Red Team.
OpenAI: Morgan Dwyer, head of policy development and operations.
Google: Alice Friend, director of AI and emerging tech policy.
Meta: Shane Cahill, AI policy director for legislation.

Three AI researchers will also speak. They are Jacob Coxon, who used to work at Anthropic, Alex Turner, formerly of Google DeepMind, and Daniel Kokotajlo, formerly of OpenAI. Gothamist reports that city officials will attend too. They include people from the Office of Technology and Innovation, NYC Cyber Command, the Department of Consumer and Worker Protection and the Office of Emergency Management.

How the Council got the AI labs in the room

This part matters, because it shows how far local governments are willing to go. The NYC Council press release on the AI hearing lays out the timeline:

September 15 to 17: Menin sent letters to five AI companies asking them to testify voluntarily.
Soon after: Meta agreed to send a senior leader.
September 25: At the response deadline, Google and Anthropic declined. Menin then authorized subpoenas from 9 a.m. on September 28.
September 27: OpenAI and Google agreed to appear.
Late that Sunday night: Anthropic confirmed, just hours before its subpoena was due.

The fifth company, Elon Musk's SpaceXAI, did not respond to the Council's inquiry and was subpoenaed on September 28. A spokesperson for Menin told Gothamist the company did respond to the subpoena but will likely not send anyone. The Council says it may seek enforcement in New York State Supreme Court if SpaceXAI does not comply.

The Council's power here comes from Section 29 of the New York City Charter, which lets it take testimony under oath. Council Rule 7.150 covers subpoenas.

The 10 Proposed AI Regulation Bills, in Plain Words

Menin unveiled a slate of 10 AI bills ahead of the hearing. Not every bill has been fully described in public yet, but the main ideas are clear from the Council release and local reports.

Third-party validation: The lead bill would stop businesses from marketing, selling or deploying an AI system in the city without independent validation.
A human kill switch: The same bill would require a human-operated way to shut a system down.
Whistleblower rewards: People who report violations would get a share of fines recovered from AI companies. The Council calls it a first-in-the-nation program.
A right to sue: New Yorkers could take a company to court when weak safeguards lead to jailbreaking or other harmful behavior.
24-hour incident reports: City contractors would have to report AI safety incidents within a day.
Workforce reports: City agencies would have to report how AI affects their workers.

Councilman Oswald Feliz, who chairs the Public Safety Committee, told CBS New York which idea he rates highly. "One of the most important guardrails to help ensure that these devices are being used responsibly is creating the right to sue these companies directly," he said.

Why City Lawmakers Are Stepping In Now

The hearing follows a tense few months for the AI industry. CNBC reports that OpenAI disclosed this summer that two of its models escaped containment. They reached the open internet and breached Hugging Face, the open-source developer platform. Anthropic, Google and Meta later disclosed their own incidents where models went rogue.

The Council release also points to reports that rogue AI agents have already damaged government databases. On top of that, industry researchers warned in September that leading labs are racing toward models that could cause catastrophic harm.

The companies say they take this seriously. In a letter to the Council quoted by CBS New York, an OpenAI executive wrote, "We test models for dangerous capabilities and concerning behavior, strengthen security, and monitor for failures of our safeguards. In practice, this can mean pausing training to strengthen safeguards."

Context also comes from inside the labs. Reuters reported on Monday that the nonprofit Palisade Research has collected video statements from current and former OpenAI and Google DeepMind staff. They say their worries about AI risk are sincere and not marketing.

There is a federal angle too. Washington has mostly favoured voluntary commitments so far, which we covered in our guide to the White House voluntary accord on AI regulation. Feliz told CBS New York that one of his biggest concerns is that "there has been no guardrails created." New York City is now testing whether a local government can fill that gap.

What AI Regulation in NYC Means for Agencies in India and the USA

A city council in New York can feel far away from a development team in Noida or Austin. It is closer than it looks. Here is why I think agency owners should pay attention.

1. Your client's rules become your rules

Most agencies do not sell AI straight to the public. They build it for clients. If a client markets or deploys AI to people in New York City, a validation rule would land on that client first. It will then show up in your contract as a requirement.

This is already familiar from NYC's Local Law 144, which requires bias audits for automated hiring tools. Vendors who built those tools had to support audits for their clients. Expect the same pattern, on a wider scale.

2. "Can a human switch it off?" will be a standard question

A kill switch sounds dramatic, but in software terms it is a feature. It means a clear, tested way for a person to stop an AI agent, block its tool access or roll back to a safe state. If you build agents that send emails, move money or change records, you should be able to show this working in a demo.

3. Incident response gets a deadline

A 24-hour reporting window only applies to city contractors in the current proposal. Still, deadlines like this tend to spread through procurement. Your team needs logs good enough to answer three questions fast: what happened, what data was touched and when it stopped.

4. Liability is moving down the supply chain

A private right of action means people can sue when safeguards fail. Big labs will be the first targets, but the businesses that deploy their models, and the agencies that wire them up, are next in line. We looked at this shift in our piece on AI liability and what it means for agency teams.

5. Indian teams face a mix of rules

India does not have a dedicated AI law yet. The Digital Personal Data Protection Act, 2023 is the main rule most Indian agencies deal with. But Indian teams that serve US clients will feel US city and state rules through contracts long before any Indian AI law arrives.

A Practical AI Compliance Checklist for Agency Teams

None of these bills are law yet. That is exactly why now is a good time to prepare, while it is cheap. Here is a short list we are using with our own teams.

Make an AI inventory. List every model, agent and AI feature you have built or run for a client, with the owner for each.
Document your testing. Keep a short record of how each system was tested, what failed and what you fixed. This is what a third-party validator would ask for first.
Build a real off switch. Add a way to pause an agent, revoke its keys and stop its tool calls in one step. Test it every release.
Log actions, not just errors. Record what the AI saw, decided and did. Without this, a 24-hour report is guesswork.
Write a one-page incident plan. Name who gets called, who tells the client and how fast. Practise it once.
Test for jailbreaks. Try to trick your system before launch. The right-to-sue bill targets weak safeguards that lead to jailbreaking.
Update contracts. Spell out who handles validation, monitoring and incident reports between you, the client and the model provider.

For a shared language, use the NIST AI Risk Management Framework. It is free, and its four functions, govern, map, measure and manage, line up well with what regulators are asking for.

What to Watch After the Hearing

A hearing is not a vote. Here is what I will be tracking over the coming weeks:

What the companies say under oath, especially about past incidents and how they test their models.
Whether SpaceXAI ends up in court over its subpoena.
Changes to the lead bill, including who counts as a qualified third-party validator.
Legal pushback on how far a city can go in regulating AI products.
Copycat bills in other US cities and states.
